Any representation and/or reproduction and/or partial or total exploitation of this site, by any process whatsoever, without the prior written authorization of Clémence DELORME is strictly prohibited and could constitute an infringement within the meaning of articles L 335-2 and following of the Intellectual Property Code.

The LILNA brand is a registered trademark. Any representation and/or reproduction and/or partial or total exploitation of these trademarks, of any nature whatsoever, is totally prohibited.

The Seller retains and shall retain full ownership of all creations, inventions, plans, drawings, diagrams and processes, developed by the Seller before or during the execution of the Contract.

  • GENERAL TERMS AND CONDITIONS OF SALE

These terms and conditions of sale are concluded, on the one hand, by the company LILNACO, email: clemence@lilnaswimwear.fr – SIRET No.: 83902971700015 and, on the other hand, by any natural or legal person wishing to make a purchase via the E-commerce website “https://lilnaswimwear.com” hereinafter referred to as “the Client.”

Purpose of the contract

The purpose of these general terms and conditions of sale is to define the contractual provisions between the company LILNACO and the Client and the conditions applicable to any purchase made through the LILNA merchant site, whether the Client is a professional or a consumer. The acquisition of an item through this site implies unreserved acceptance by the client of these terms and conditions of sale.

  • Selling Price:

Prices on the website: www.lilnaswimwear.com are indicated in Euros and include all taxes (TTC).

Product prices do not include delivery costs.

The amount of shipping costs is specified on the site before order validation.

  1. Orders

The customer places an order on the website https://lilnaswimwear.com. To purchase one or more items, they must follow the following ordering process:


– Selection of items and addition to cart,
– Validation of cart contents,
– Identification on the website or registration on the identification form where all requested contact details will be entered,
– Choice of payment method and acceptance of the GTCS,
– Payment validation.

The customer will receive an order confirmation email as well as an invoice.
Once the package is sent, the customer will receive a confirmation email with the Colissimo or Lettre Max tracking number, so that they can track the delivery progress.

Any order implies an obligation to pay, and as such, LILNA reserves ownership of the items until full payment of the order, i.e., until LILNA collects the price of the order.

  1. Payment Methods

Payment for purchases can be made via one of the following methods, at the Client's convenience:

  • Right of Withdrawal:

LILNA reserves the right to cancel or refuse any order originating from a customer with whom there is a dispute regarding the payment of a previous order. Any order constitutes acceptance of the prices and descriptions of the items available for sale.
LILNA undertakes to fulfill orders received on the website only within the limits of available stock.

  • Modifications to the GTCS:

Given possible changes to the site and regulations, LILNA reserves the right to modify the GTCS at any time.

Only the GTCS in force at the time of the conclusion of the contract will be enforceable against customers.

III. PROTECTION OF PERSONAL DATA

The Client is informed and accepts that their personal data may be collected on the Site and used by LILNA, which acts as data controller within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter "General Data Protection Regulation" or "GDPR").

LILNA undertakes to protect and ensure the security and confidentiality of its Clients' personal data in accordance with the GDPR, in particular by taking all useful precautions to prevent these data from being distorted, damaged, or accessed by unauthorized third parties.

In particular, Clients' personal data may be transmitted to service providers and contractual partners who, as subcontractors within the meaning of the GDPR, intervene and directly contribute to the management of Orders and for whom it is absolutely necessary to access the personal data provided by the Client when creating and using their Account (identity, postal address, telephone number, email address). Subcontractors may only act on instructions from LILNA.

Clients' personal data are collected for the following purposes:

  • managing Orders and customer relationships;
  • informing Clients about offers and commercial information related to the brand;
  • strengthening and improving the communication of the Website and the brand by sending, in particular, newsletters and special offers based on Client preferences observed on the Site;
  • improving and personalizing the services offered to Clients; and
  • complying with legal and regulatory obligations.

Client's personal data are kept only for the period strictly necessary for the purposes outlined above.

In accordance with the GDPR, the Client has a right of access, rectification, and opposition to personal data concerning them (hereinafter the "Data Protection Rights").

To exercise one or more of the Data Protection Rights, the Client must send a request by email to LILNA's Customer Service, by filling out the contact form located on the site and indicating their name, first name, email address, and customer references.

Each request must be accompanied by a photocopy of an identity document bearing the Client's signature and specify the reply address.

The response to the request made on the basis of one or more Data Protection Rights will be sent within 2 months following receipt of the request.

The Client may communicate specific directives to LILNA in which he or she defines how he or she intends to exercise, after his or her death, the Data Protection Rights in accordance with the GDPR.

  1. APPLICABLE LAW / DISPUTE RESOLUTION

Disputes arising at the occasion or in connection with the Contract will be submitted to mediation, and failing amicable settlement within two (2) months from the filing of the request, they will be brought before the Commercial Court of La Rochelle.

  1. COOKIES

This "COOKIES" section provides more information on the origin and use of browsing information processed during the consultation of our Site and on users' rights.
